Consumers are more in debt then ever before. This makes for even tougher tactics on the Collectors part. Consumers are being harassed and threatened more and more and think they have no rights and simply have to listen. This causes additional stress and despair to situation that already seems hopeless.

Consumers do have rights when it comes to all the collection calls and threats, here are just a few tips:

  1. Consumers need to prioritize their bills. An unpaid credit card bill is not the most important bill. Always make sure you pay secured debt, such mortgage, vehicles and other items where you have pledged collateral, or rent first. Work your way down the list, utilities, insurance, food, etc. Pay first what it takes to survive.

  2. "Do I have to listen to the collectors when they call?" No, debt collectors may not threaten violence or harm, use obscene language, or repeatedly use the telephone to annoy someone. Collector's tactics can be dirty and illegal. HANG UP!!!

  3. Debt collectors may not falsely say they are attorneys, imply that you have committed a crime by not paying this debt. They cannot threaten to have you arrested, seize, garnish, attach or sell property unless they really intend to do so.

  4. Tell the collectors to STOP calling. Then follow up by sending a certified letter to the collector, so you'll have proof that the debt collector received it. Once the collector receives the letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. This DOES NOT make the debt go away and the original creditor may still sue you
