How do I know if I need to file a Chapter 7?

The first step in determining whether you would qualify to file a Chapter 7 Bankruptcy is to review your monthly income and expenses and if after paying all of your bills you have little or no income remaining, then you may be a candidate for Chapter 7.

  1. Do your debts mainly consist of credit cards, medical bills, repossessions, and/or wage garnishments?

  2. Have you recently lost your job, or had a decrease in your normal income?

  3. Have you recently gotten divorced or separated from your spouse and was left with all the bills?

If you possess personal or real property that has a cash value exceeding $1,000.00 then I strongly urge you to seek the advice of a bankruptcy attorney in your area. Locate an attorney that specializes in bankruptcy law.

The reason for this is because if you have assets that you own free and clear, those assets may become property of the bankruptcy estate and those assets may be sold to satisfy debts to your creditors. In a situation like that, a good bankruptcy attorney can help you protect your assets.

Filing bankruptcy can be a very emotional and having to deal with creditors calling you while you are recuperating from an illness, or dealing with a job loss is hard, and often intimidating.

Creditors would have you believe that most people who file bankruptcy are bad people and do it just to get out of paying their debts, but that is not true.

The majority of people who file bankruptcy have lost their job, had major medical problem or are going through a divorce that has seriously affected their income. If you can not seem to catch up you should seriously consider filing bankruptcy.
